
RE: Apartment A-115 – Unresolved On-Demand Hot Water Heater (ODHWH) Failure
To Monarch Management, This letter serves as formal notice regarding a hazardous
maintenance condition in Apartment A-115 that has remained unaddressed for three
years.
During a routine air filter change for the HVAC system on 2/20/26,
I accessed the diagnostic interface of the Navien On-Demand Hot Water Heater.
I have captured the internal error log in the attached photograph (See Exhibit A)
for legal and maintenance reference. Evidence of System Failure (Reference:
Exhibit A) As shown in the attached image, the unit is currently reporting a
recurring history of the following critical codes: Error 003 (Ignition Failure):
Indicates a failure to light correctly, leading to potential gas accumulation
and "hard start" combustion risks. Error 060 (Dual Venturi/Fan Speed Error):
Indicates a malfunction in the air-to-gas mixing and exhaust ventilation system.
Safety & Liability Warning These specific codes represent a documented Life
Safety Risk. A malfunctioning Venturi or fan system can lead to incomplete
combustion, resulting in the production and leakage of Carbon Monoxide (CO)—a
colorless, odorless, and potentially lethal gas—into the living quarters.
Furthermore, repeated ignition failures pose a persistent fire and explosion
hazard. Documented Negligence For three years, I have submitted multiple
maintenance requests regarding this system. Monarch Management has consistently
failed to act, with requests being deleted from the portal or falsely marked as
"Work Complete" when no technician ever arrived. This level of professional
negligence is inexcusable. I am certain that if a tenant were three years late
on rent, Monarch would have taken immediate legal action. I expect the same
level of urgency regarding the safety of my home. Demand for Immediate
Resolution I am requesting an inspection and repair by a licensed and qualified
plumber (certified in Navien systems) within 24 to 48 hours.
